Terms of Service

Pay Oper is a read-only document review tool. You upload or forward your weekly settlement statement and your signed lease. The Service parses those documents, itemizes each deduction line, and indicates where a charge does not appear in your lease or differs from the amount your lease specifies. The Service also tracks escrow balances and calculates cost per mile from settled weeks you provide.
The following describes what the Service does not do, and these limits are fundamental to the arrangement between us:
- Pay Oper never receives, holds, transmits, or takes custody of your money. The Service is read-only with respect to funds.
- Pay Oper does not advance funds against a future settlement, purchase receivables, factor invoices, or extend credit of any kind.
- Pay Oper does not charge a contingency fee or take any percentage of amounts you recover. Subscription pricing is flat.
Pay Oper does not contact your carrier, broker, or any third party on your behalf. Every request generated by the Service is sent by you, from your own email account, in your own name.
Pay Oper is a software product, not a law firm, not a licensed attorney, and not a financial advisor. Nothing the Service produces is a legal opinion, legal advice, or a determination that any charge is unlawful.
- Where the Service references a regulation, it does so to point you to the text of the rule so you can read it yourself. Output of the Service states only that a charge does not appear in your lease, or that it differs from the amount your lease specifies. It never states that a deduction is illegal, fraudulent, or actionable.
- Whether to raise a discrepancy with your carrier, and how, is entirely your decision. If you want an opinion on your legal rights, consult a licensed attorney in your state.
- You also acknowledge a practical reality that the Service cannot change: raising a deduction dispute with a carrier is a business decision with business consequences.
- Pay Oper takes no responsibility for how a carrier, broker, or dispatcher responds to any request you choose to send.
4. Accuracy of Your Documents. The Service can only be as accurate as the documents you give it. You are responsible for uploading complete, legible, and current copies of your settlement statements and your signed lease, including any addenda or amendments. If your lease has been amended and you have not provided the amendment, the Service may flag a charge that is in fact authorized. Review every flag against your own records before acting on it.
You must provide accurate account information and keep your login credentials confidential. You are responsible for activity under your account.
Paid plans renew automatically at the interval you select until cancelled. You may cancel at any time and your access continues through the end of the paid period. Because the Service is delivered digitally and consumed on access, subscription fees are not refundable except where required by law.
The Service, including its software, parsing logic, interface, text, graphics, and the Pay Oper name and logo, is owned by Pay Oper and protected by copyright, trademark, and other intellectual property laws. You receive a limited, non-exclusive, non-transferable, revocable license to use the Service for your own trucking operation. You may not copy, reverse engineer, resell, sublicense, or build a competing product from the Service.
You retain all rights to the settlement statements, leases, and other documents you upload. You grant Pay Oper only the license needed to store, parse, and display those documents back to you, and to operate and improve the Service.
Pay Oper runs one text message program and it exists for promotional marketing only. It is not the channel we use to deliver your settlement analysis, and nothing about your account depends on it.
When you enter your mobile number and opt in, you are agreeing to receive recurring promotional texts from Pay Oper at that number, sent using an automatic telephone dialing system. That agreement is optional. You can subscribe to any Pay Oper plan, free or paid, without ever joining the text program, and declining it changes nothing about the Service you receive.
- You can cancel texts at any time by sending STOP to the number that texted you. We will send one confirmation, then stop. To join again later, submit the form on this site.
- For help, reply HELP or email support@payoper.com. Carriers are not liable for delayed or undelivered messages.
- Message and data rates may apply to all messages sent to and received from Pay Oper. Message frequency varies. For questions regarding your text or data plan, please contact your wireless provider. Supported carriers are: AT&T, T-Mobile, Metro PCS, Verizon Wireless, US Cellular, Google Voice, Cellular One, Cellcom, Cellular South, Interop, Clearsky.
Mobile numbers collected for this program stay with Pay Oper. We do not sell them, rent them, or pass them to third parties or affiliates for their own marketing. How we handle that data is set out in our Privacy Policy.
The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Pay Oper disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
- Pay Oper does not warrant that the Service will be uninterrupted, error free, or that every discrepancy in a settlement statement will be detected, or that every flag it raises will turn out to be a genuine discrepancy.
- 9. Limitation of Liability. To the fullest extent permitted by law, Pay Oper and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost freight, lost business opportunity, or loss of a carrier relationship, arising out of or relating to your use of the Service, whether based in contract, tort, or any other theory, and whether or not Pay Oper was advised of the possibility of such damages.
Pay Oper's total aggregate liability for all claims relating to the Service will not exceed the amount you paid Pay Oper in the twelve months preceding the event giving rise to the claim.
These Terms are governed by the laws of the State of Ohio, without regard to its conflict of law provisions. Any dispute arising under these Terms will be brought exclusively in the state or federal courts located in Franklin County, Ohio, and you consent to the jurisdiction of those courts.
Pay Oper may revise these Terms from time to time. When we do, we will post the updated Terms on the website and, where the change is material, notify account holders. Your continued use of the Service after the revised Terms are posted constitutes your acceptance of them.
